These terms govern your use of List Mantis (the "Service"), provided by Whale & Wave Digital Ltd, a company registered in England and Wales (company number [COMPANY NUMBER]), with its registered office at [REGISTERED ADDRESS] ("we", "us", "our").
By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. The Service
List Mantis monitors third-party marketplace websites (including Facebook Marketplace, eBay, Gumtree, AutoTrader, and Vinted) for new listings matching your saved searches, and sends you alerts by email and/or push notification.
What we are: A notification and monitoring tool. We help you find listings faster.
What we are not: We are not a marketplace. We do not sell, buy, broker, or facilitate transactions. We have no control over listings, sellers, prices, or the availability of items on third-party platforms. Any transaction you enter into with a seller is entirely between you and that seller.
2. Eligibility
You must be at least 18 years old and resident in the United Kingdom to use the Service. By creating an account, you confirm that you meet these requirements.
3. Accounts
Registration
The Service is currently invite-only. You need an invitation from us to create an account. We may open registration to the public in the future.
You must provide accurate information when creating your account. You are responsible for keeping your login credentials secure. If you believe your account has been compromised, contact us immediately at hello@listmantis.com.
Account limits
Each account is for a single individual. You may not share your account with others or create multiple accounts. We reserve the right to set limits on the number of active searches per account.
4. Subscriptions and payment
Free and paid plans
We may offer both free and paid subscription plans. The features, limits, and pricing of each plan are described on our website and may change over time.
Billing
Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing, you authorise us to charge your chosen payment method at the start of each billing period.
All prices are in British Pounds (GBP) and are inclusive of VAT where applicable.
Cancellation
You may cancel your subscription at any time through the Stripe customer portal or by contacting us. When you cancel:
- Your subscription remains active until the end of the current billing period.
- You will not be charged again after cancellation.
- You retain access to paid features until the billing period ends.
Refunds
We do not generally offer refunds for partial billing periods. However, if you believe you have been charged in error or are otherwise dissatisfied, contact us at hello@listmantis.com and we will review your case on its merits.
Failed payments
If a payment fails, we will attempt to retry as managed by Stripe. If payment cannot be collected after reasonable attempts, we may downgrade or suspend your account until payment is resolved.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to circumvent rate limits, access controls, or security measures.
- Scrape, copy, or redistribute data obtained through the Service (alerts, listing data, images) for commercial purposes beyond your own personal use.
- Use the Service to harass, stalk, or harm any person, including sellers on third-party platforms.
- Use automated tools (bots, scripts) to interact with the Service beyond its intended interface.
- Resell or sublicense access to the Service without our written permission.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
6. Third-party platforms
List Mantis accesses publicly available listing data from third-party marketplace websites. We are not affiliated with, endorsed by, or partnered with Facebook/Meta, eBay, Gumtree, AutoTrader, Vinted, or any other platform we monitor.
Third-party platforms may change their structure, terms, or availability at any time. This may affect the Service's ability to find or deliver alerts for certain platforms, either temporarily or permanently. We will make reasonable efforts to restore functionality but cannot guarantee uninterrupted coverage of any specific platform.
Your use of third-party platforms is subject to their own terms of service and privacy policies. We are not responsible for the content, accuracy, legality, or availability of listings on those platforms.
7. Vehicle data
For vehicle searches, the Service may extract registration numbers from listing images and retrieve MOT history from the DVSA's publicly available records. This data is provided for informational purposes only.
We do not verify the accuracy of vehicle information. MOT data, mileage records, and other vehicle details may be incomplete, outdated, or incorrect. Always conduct your own checks (including an independent vehicle history check) before purchasing a vehicle.
8. Intellectual property
All content, code, design, and branding of List Mantis (excluding third-party listing data) is owned by Whale & Wave Digital Ltd or its licensors. You may not copy, modify, or distribute any part of the Service without our written permission.
Listing data (titles, images, prices, descriptions) belongs to the respective sellers and platforms. We cache listing images temporarily to deliver a reliable alert experience. We do not claim ownership of third-party content.
9. Availability and changes
We aim to keep the Service available and reliable, but we do not guarantee 100% uptime. The Service may be unavailable due to maintenance, updates, third-party outages, or circumstances beyond our control.
We may modify, suspend, or discontinue any part of the Service at any time. If we make changes that materially reduce the functionality you are paying for, we will give you reasonable notice and, where appropriate, a pro-rata refund.
10. Limitation of liability
To the fullest extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee the accuracy, completeness, or timeliness of listing data, alerts, or vehicle information.
- We are not liable for any loss or damage arising from your reliance on data provided through the Service, including (without limitation) any purchase decision you make based on listing or vehicle data.
- Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months immediately preceding the claim.
Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your breach of these terms, or your interactions with third-party sellers or platforms.
12. Privacy
We collect and process personal data as described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
13. Termination
By you
You may stop using the Service and request deletion of your account at any time by contacting us at hello@listmantis.com or using the account deletion feature within the app (when available). We will delete your data in accordance with our Privacy Policy.
By us
We may suspend or terminate your account if you breach these terms, if we are required to do so by law, or if we discontinue the Service. Where possible, we will give you reasonable notice before termination.
14. Disputes
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

15. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email or by a notice within the app at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated terms. If you do not agree to the changes, you should stop using the Service and cancel your subscription.
16. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
17. Entire agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Whale & Wave Digital Ltd regarding your use of the Service. They supersede any prior agreements or understandings.
